SHOPKEEPERS near graffiti hotspots could face heavy fines after selling spray paint to under-16s.

Durham Police identified graffiti as a major reason for people believing the county was not safe to live in when it launched a StreetSafe clampdown on anti-social behaviour two years ago.

In recent weeks, teenage volunteers were sent by Durham County Council trading standards officials into shops near areas where graffiti has been a severe problem.

Of the eight shops tested, two in Durham City served a 13-year-old and one shop in Willington served a 15-year-old with spray paint.

Last night, trading standards divisional manager Chris Cooper said he would not rule out further action against the stores.

Under the Anti-Social Behaviour Act shopkeepers could face a £2,500 fine for selling the paint.

Mr Cooper said: "At the moment, we are carrying out investigations as to why the teenagers were sold the items, and we reserve the right to take further action.

"We are not trying to trick anyone. A child is sent into the shop to do a nominal test purchase. They pick up an item and take it to the counter.

"If questioned, the volunteers are just told to tell the truth. They don't give a false date of birth or a false age, all the retailer has to do is ask them how old they are.

"We just want retailers to carry out their obligations."

Durham Police's head of community safety, Chief Inspector Jeff Watson, said StreetSafe had identified graffiti as a major concern.

He said: "It contributes to a feeling that an area is unsafe, and we regard it quite simply as criminal damage.

"We welcome this operation and hope that it sends traders a clear reminder of their responsibilities."

The sales to the youngsters came after visits and letters to the shops from trading standards officers, advising on products that should not be sold to children. The team also warned the shops that test purchases could be made.

During tobacco and alcohol tests, as part of the same operation, no sales of tobacco were made in five attempts.

A shop in Bishop Auckland was the only one from 14 tests across the county to sell alcohol to a 15-year-old.
