A persistent criminal has been branded an ‘absolute pest’ as he was locked up for her latest bout of offending.
Lee Percival walked into one person’s home and tried to steal some drinks before being chased off when he was confronted by the occupier.
The 40-year-old had earlier stolen a bottle of beer from a Sainsbury’s shop before being taken to hospital by concerned police officers when he was spotted in a dishevelled state outside the same shop.
Teesside Crown Court heard how Percival had been made subject of a criminal behaviour order (CBO) just weeks before he was arrested in June after he assaulted a police officer.
Nigel Soppitt, prosecuting, said Percival walked into the house on Briar Road, Thornaby, under the mistaken impression that it was the home of a friend, but was confronted by a man when he tried to walk up the stairs.
He said the defendant became abusive when the police took him to hospital and called them ‘nonces, rats and threatened to bray their faces in’.
Mr Soppitt said the defendant assaulted the officer while they were waiting with him at the hospital.
Percival, of no fixed abode, pleaded guilty to burglary, breaching his CBO, theft from a shop and assault PC following his arrest on June 23.
Tom Bennett, mitigating, said his client had a long history of short custodial sentences on his record and had served his longest spell in prison while on remand for his latest offences.

He said: “He acknowledges that he has an unenviable record for low-level offending. He is someone who has been subject to short sentences which stem from offences from an ongoing issue with substance misuse.”
Judge Amanda Rippon branded Percival an ‘absolute pest’ as she jailed him for a total of 32 months for all offences.
She said: “It is absolutely right that alcohol is the issue which has led to your offending over very many years now – you are an absolute pest and worse when you are drunk.
“You have committed a lot of your offences whilst drunk, and you have assaulted police officers when you are drunk.”
