A WOMAN who slipped and fell on a wet floor in a supermarket has been told the store is not liable for her injury.

Marilyn Wray, 49, who lives in Darlington, was shopping at Asda, in Whinbush Way, Darlington, in September when she slipped and fell in an aisle, injuring her back.

She said there was no sign saying the floor was wet and that since the accident, she had been unable to work as a nurse at Darlington Memorial Hospital.

Ms Wray wrote to Asda asking for compensation soon after the accident but only received a reply last month.

The letter, from the supermarket's head office, told Ms Wray that the cleaning in the store was carried out by a Scottish contractor, which would be liable for any compensation claim.

Ms Wray, who believes she will not be able to return to nursing because of her injury, said: "I was in an Asda store and was their customer, not the customer of a Scottish cleaning company.

"I would have thought the supermarket would have had a bit more concern for its customers.

"I am still in pain, I cannot stand or sit in one place for long and I cannot work. But I am no nearer getting compensation."

A spokeswoman for Asda said the store was not legally liable for Ms Wray's injuries as the cleaning work was not carried out by its staff.

She said details of the incident had been passed to the cleaning company's insurance firm, which would contact Ms Wray directly.

The spokeswoman said: "We are obviously concerned that this has caused her distress.

"We will endeavour to help her in any way we can and we are here if she wants to contact us."
