A MAN who received a suspended prison sentence for assaulting his partner, breached it just six weeks later by visiting her, a court heard.

Jack George Milburn was given the 15-month sentence, suspended for 18 months, and made subject of a restraining order, “until further order”, by Judge Simon Hickey at Durham Crown Court, on May 17.

It followed his admissions to assaulting his partner, causing her actual bodily harm, and damaging property at her Esh Winning home, on March 16.

But the 24-year-old, of Pringle Place, New Brancepeth, was back before the court for sentence for damaging property, and breaches of the suspended sentence order, the restraining order and a non-molestation order.

The court heard they were all committed by him visiting her home in the early hours of June 29 while under the influence of drink and possibly also drugs.

Rebecca Brown, prosecuting, said he repeatedly banged on the door, before leaving, but then returned and climbed into her bedroom window to tell her of his “undying love”.

Following his departure, the police were alerted and Milburn was, again, arrested.

Appearing by video link from the nearby prison, he admitted the offences, including the various breaches and damaging the house door.

Liam O’Brien, mitigating, said Milburn found it hard to get over the break-up of the relationship.

Passing sentence, Recorder Ray Singh said, given that it was just six weeks after the previous orders were put in place by Judge Hickey, there was no reason not to activate the suspended 15-month prison sentence in full.

He added a further month for the other breaches, making a total 16-month sentence.
