POLICE say a 45-year-old man who was abusive and threw mud at emergency service workers trying to help him after landing his car in a tree received a driving ban.

Shortly before 11pm on October 22 last year, police attempted to stop Lee Alty of Lyndhurst Road, Birkdale, on the A645 but he’d ignored their requests and almost collided with the rear of a stationary police vehicle.

A short time later, police say he failed to negotiate a sweeping corner in Hensall and left the road, eventually coming to rest in a tree some distance from the ground.

According to police, during his rescue and assessment, Alty was “extremely” abusive towards emergency workers trying to help him.

He threw mud at the workers and was also abusive to the medical professionals treating him at York District Hospital.

Alty refused to cooperate with officers requesting preliminary or evidential samples of analysis and was also found to be driving with an expired MOT.

Alty was sentenced at York Magistrates Court last Thursday after pleading guilty to driving without due care and attention, failing to provide a specimen and being drunk and disorderly.

He received an 8 week suspended prison sentence, 200 hours of unpaid work, rehabilitation requirement and a driving ban of 29 months, and he was made to pay £203 in court costs.

PS 166 Campbell a neighbourhood policing sergeant for the area, said: “I was lucky not to have been knocked down when this driver failed to comply with my direction to stop his vehicle after almost colliding with ours.  I welcome the sentence handed down by York Magistrates court and believe it truly reflects the serious nature of the offence.

"I am sure many of you reading this will use this piece of road on a regular basis as do your friends and family, it doesn’t bear thinking about what could have happened if one had encountered this driver in his intoxicated state that night.
