(ENGLAND) ORDER 2015 NOTICE OF CANCELLATION OF 1976 ARTICLE 4 DIRECTION: LANCHESTER CONSERVATION AREA NOTICE OF CONFIRMATION OF 2016 ARTICLE 4(1) DIRECTION: LANCHESTER CONSERVATION AREA
On 11th July 2016, The County Council of Durham ("the Council") made a Direction under Article 4(1) of the Town and Country Planning (General Permitted Development) Order 1995, as amended ("the Order"), to which Article 6 of the Order applies.
The Council consulted on the 2016 Article 4(1) Direction from 11th July 2016 to 8th August 2016 and has now considered representations received during this period. The Direction came into effect on 11 th July 2016 and the Council confirmed the Direction on 10th January 2017.
The 2016 Article 4(1) Direction relates to the following properties within the Lanchester Conservation Area as shown on the plan attached to the Direction:
Bishop Bek House 1-4, Bluebell Court 1-4,Cecil Crescent 1-4,Church View 1-7 & 8, Croft View 1-17, Ford Road, 1,6-13, Elm Lea and Ford View, Front Street 7, 22, 24 , 29,35, 37 (Lanchester Cottage) 39, Greta Place 1-4, Hallgarth Terrace 1-4 & Hallgarth House & Newgate House, Kitswell Road 1-17 & 30 &31, Mill Cottages 1-3, Old Court House 2 & 3, Percy Crescent 2-10, Percy Place 1-5, Prospect Terrace 1-8, StationRoad1-6, 10, 11, ParkHouse Cottage, Rowan Cottage, The Garths 1-14, The Square 1-3, Victoria Terrace 1-30 and The Bungalow.
The 2016 Article 4(1) Direction relates to the following parts of the Town and Country Planning (General Permitted Development) (England) Order 2015:?
Part 1: Development within the curtilage of a dwellinghouse, where that development would front a relevant location *
Class A: The enlargement, improvement or other alteration of a dwellinghouse
Class C: The alteration to a roof of a dwellinghouse
Class D: The erection or construction of a porch outside any external door of a dwellinghouse
Class E: The erection or alteration of buildings or enclosures, swimming or other pools incidental to the enjoyment of a dwellinghouse or containers used for domestic heating purposes
Class F: The laying of hard surfaces incidental to the enjoyment of a dwellinghouse
Class G: The installation, alteration or replacement of chimneys, flues or soil and vent pipes on a dwellinghouse
Part 2: Minor Operations, where that development would front a relevant location*
Class A: The erection, construction, maintenance, improvement or alteration of a gate,
fence, wall or other means of enclosure
Class C: The painting of the exterior of any building or work.
*A relevant location refers to a highway, waterway or open space.
The effect of the Direction is that the types of development above may no longer be carried out at the properties specified without a grant of planning permission.
The Council is satisfied that it was expedient that the 1976 Lanchester Conservation Area Article 4 Direction be cancelled. The cancellation came into force on10th January 2017.
