NOTICE OF CONFIRMATION OF AN ORDER HIGHWAYS ACT 1980 WILDLIFE AND COUNTRYSIDE ACT 1981 THE COUNTY COUNCIL OF DURHAM (PUBLIC FOOTPATH NO. 8 MUGGLESWICK PARISH)
PUBLIC FOOTPATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2015
On 14.04.16, The County Council of Durham confirmed the above order made under section 119 of the Highways Act 1980. The effect of the order as confirmed is to divert Public Footpath No. 8 Muggleswick Parish from a point north on the unclassified road Spring Hill, south of Shield Farm, proceeding in an easterly then southerly direction past Dyke House to a point south east of the farmyard onto a line running from a point some 20mts further south on Spring Hill proceeding in an easterly direction to the same point south east of the farmyard, as shown on the order map. The order comes into force as from21.04.16, butifanypersonaggrievedbytheorderwants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 of the Act as applied by paragraph 5 of Schedule 6 of the Act, within 6 weeks from 21.04.16, make an application to the High Court.
NOTICE OF CONFIRMATION OF PUBLIC PATH ORDER PUBLIC PATH DIVERSION ORDER TOWN AND COUNTRY PLANNING ACT 1990, SECTION 257 WILDLIFE AND COUNTRYSIDE ACT 1981, SECTION 53SA(2) THE COUNTY COUNCIL OF DURHAM (PUBLIC FOOTPATH No. 4 MUGGLESWICK PARISH) PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2012
The effect of the order as confirmed is to divert the public footpath running froma point some 10mts south ofthe yard at Low Horsleyhope Farm and proceeding in a generally northerly direction, through the yard at Low Horsleyhope Farm for a distance of some 40mts where it joins Footpath No. 3 Muggleswick Parish, north of the buildings, onto a line running from the same point south of the yard at Low Horsleyhope Farm and proceeding in a north westerly direction for a distance ofsome 16mts to a point to the south west ofLow Horsleyhope Farm, then in a northerly direction for a distance of some 22mts tothejunctionwithFootpathNo. 3 MuggleswickParishtothe north west of Low Horsleyhope Farm, as shown on the order plan. The order came into force on 17.02.16 but if any person aggrieved by the order desired to question its validity or that of any provision contained in it on the ground that it is not within the powers of the above Act, or on the ground that any requirement of that Act or any regulation made under it has not been complied with in relation to the confirmation of the order, he or she may apply to the High Court for any of these purposes under section 287 ofthe Town and Country Planning Act 1990 within 6 weeks from the date on which notice is first published as required by paragraph 7 of Schedule 14 to the Act.
