NOTICE OF CONFIRMATION OF MODIFICATION ORDER SECTION 53 OF THE WILDLIFE AND COUNTRYSIDE ACT 1981 ("THE ACT")

Definitive Map & Statement of Public Rights of Wayfor (FP176 Swan Farm Close Blackburn) (Definitive Map Modification) Order 2021
On 27th May 2021 Blackburn with Darwen Borough Council confirmed the above-named order as made as it was unopposed. The effect of the Order as confirmed is to modify the definitive map and statement for the area by adding a public footpath from Swan Farm Close running in a North Westerly direction across a grassed surface for approximately 9 metres in length and 1.5 metres in width. The path then turns in a Westerly direction running close to the boundary of No.21 Swan Farm Close for approximately 6m in length and 1.5 metres in width, again across a grassed surface. The path then turns again in a North Westeriy direction for approximately 11 metres in length and 15m in width, still running over a grassed surface. The path then turns again in a Westerly direction for approximately 3m in length and 1.5 metres in width to the point where there is a kissing gate in place leading to the stone track on the western side of the plot. At this point on the stone track the footpath becomes approximately 2.5 metres in width and the path finally turns in a Northerly direction for approximately 13 metres in length and approximately 25 - 3.5 metres in width varying along its length.
This then joins footpath 112 Blackburn, at this point the path is approximately 3.5 metres wide.
A copy of the Order as confirmed can be inspected free of charge at both Blackburn and Darwen Town halls or alternatively the Order and map are available on request by emailing

The Order comes into force immediately, but if a person aggrieved by the Order wants to question its validity of the Order on the grounds that it is not within the powers of section 53 of the Act, or that any of the requirements of Schedule 15 of the Act have not been complied with in relation to the Order he or she may, within 42 days from the date of this notice make an application to the High Court under paragraph 12 of Schedule 15 of the Act.
