A HOMOSEXUAL man with HIV sexually assaulted a straight man he took home after the pair met in a gay bar while the alleged victim slept, a court heard.

Christopher Wales, 38, of Ashling Way, Middlesbrough, is charged with sexually assaulting a 20-year-old man he took home by performing a sex act on him in the early hours of Saturday, April 5 last year.

Teesside Crown Court heard that the younger man then scrawled the word 'rape' on the bathroom floor using toothpaste after waking to find a naked Wales sexually assaulting him, a charge denied by Wales.

A jury at the opening of the trial heard that the alleged victim had already hit Wales several times before breaking a window and throwing a mirror down the stairs. In what he himself described as an act of revenge for the sex attack the younger man then broke a hole in a bedroom door and pulled Wales through it in act compared to a famous scene in the film The Shining in court.

Richard Bennett, prosecuting, said the younger man had been out with friends on Friday, April 4, 2014 and had planned to stay the night with his girlfriend who he has been with since he was 13 years old. However his girlfriend wanted to stay with friends and the man decided to have another drink alone. He went to a newly established gay bar called Tiny near Albert Road not, at first, knowing it was a gay pub although he was informed by doormen.

Inside he met Wales, an acquaintance, and later on the pair went to Wales' home. The alleged victim claims he eventually went to bed in the spare room but awoke at about 6.30am to find Wales naked and performing a sex act on him.

Mr Bennett said: "He immediately threw him off saying 'I'm not gay'. His path was blocked and he punched him (Wales) repeatedly causing a number of injuries. The fact that Mr Wales was HIV positive was not communicated with the man. There's no doubt that sex took place. The issue is one of consent."

The alleged victim was questioned via video link.

He admitted punching Wales several times, including once while Wales was on the bed, but said it was in self-defence as Wales was blocking his exit from the bedroom saying 'don't tell anyone'.

However he later admitted he returned later, after breaking a bedroom window and writing the word 'rape' on the bathroom floor, to confront Wales a second time.

He said: "I felt like I wanted my revenge. I broke through the door an pulled him through. I was shouting an screaming. I was just angry."

Robert Mochrie, defending, said the man was embarrassed about experimenting with his sexuality and was trying to cover up, which the alleged victim denied.

The younger man was tested for HIV but the test was negative.
