A MAN who tried to break into a garden shed while the householder slept has been refused bail by a judge.
Lee Fenton, 27, admitted attempted burglary on June 25 this year of the shed in Middlesbrough.
Teesside Crown Court heard how Fenton had been remanded in custody since June, so had already served the equivalent of an eight month jail sentence.
However Fenton was not able to be sentenced since a co-defendant, who has pleaded guilty to trying to force patio doors at the property, was not present in court.
Recorder Martin Bethel said he was glad that the case was being resolved, but he could not grant bail since an application properly needed to be made to a judge in chambers.
He said Fenton, of Wicklow Street, Middlesbrough, would remain in custody while a pre-sentence report was prepared on him.
