Authority faces court over worker who lost arm in wood chipper

A COUNCIL will face prosecution over an accident in which a landscape worker lost an arm.

Shaun Talbot was pulled into a wood chipper as he fed in hedge trimmings by a roadside in Spennymoor, County Durham, on Tuesday, August 4, 2009.

The Health and Safety Executive investigated the incident and this week confirmed it will take action against Durham County Council.

The authority is accused of failing to ensure, as far as reasonably practicable, the safety of an employee.

The case is due to be heard at Darlington Magistrates’ Court on February 22.

Mr Talbot was part of a grounds maintenance team pruning trees, near Atherton Close, Spennymoor.

As he fed trimmings into the chipper, his left arm became trapped in the blades.

Colleagues managed to switch off the machine, but surgeons had to amputate his arm. He remained conscious throughout his ordeal.

Council staff helped emergency crews safely release him before he was airlifted to The James Cook University Hospital, in Middlesbrough.

The 26-year-old has since undergone seven operations on his back and shoulder and hopes to meet specialists in the next few months to be measured for a prosthetic arm.

Parks and gardens staff who were at the scene of the accident were later awarded Durham County Council Chairman’s medals for the way they responded.

Mr Talbot and his friends and family have held several events in aid of the Great North Air Ambulance.

Mr Talbot joined the former Sedgefield Borough Council’s landscaping staff when he was 17 after he left Ferryhill Comprehensive School.

The council said it was unable to comment because of the court action.

For cry out load the guy has lost his arm......what difference would PPE equipment make with one of these machines. Get real you jobs worth.

Liamsm, Look I know, and it could've made a hell of a difference, being as I work in that industry, with those kind of machines, so don't call me a jobs worth, you benefit heathen, and yeah there is always one being real bishop1!

As your questions are aimed at the individual I feel you have not quite got the gist of what you have just read. This article is actually about the HSE taking action against the council for "failing to ensure, as far as reasonably practicable, the safety of an employee" They have carried out their investigations and feel they have grounds to take action against the council not the individual. You will have to wait for the case going to court to discover whether he was wearing the correct PPE or even if he was issued with the correct PPE and the same goes for the training but if the answer to your questions are both no then surely that is even more reason for the HSE to prosecute the employer??

ChezzaB, Yeah whatever, forget all that, I think I should know, what I've just read love, maybe the council should have provided training for him, on this machine, after working with it, for so long, for years, whether they have or haven't already, or whether this was his first time using the chipper, plus if the authority provided him, with the PPE, they deemed adequate enough, for him to use this machine, then it is his fault, as an employee, of the employer, for not wearing it, then they should be prosecuting him, not the council!

Not in the slightest bit patronising there hey "love"? Like I have said you will have to wait until the court case to get the answers to your questions. Can I also suggest that before you start criticising the young man you also wait for that court case if infact there is one. He lost his arm in a freak accident, one which may or may not have been preventable but as the HSE are taking action against the council that suggests to me that the council not the young man may have been able to prevent it. You mention that you yourself work in that industry I hope you don't ever have a major accident at work, but if you are unfortunate to I take it you won't even consider taking any legal action against your employer??? Yeah whatever I very much doubt it!! By the way no one is prosecuting this young man so I take it this means he should be exonerated from these kind of accusations but there seem to be a small minority ie you that would rather read more into it than there is love!!

Sorry, I was just trying to de-stress the situation of tension, love, yeah fair enough then, I doubt I ever will because I try to be as safe as I can, whilst not compromising my working efficiency, love, and to be quite honest if it was my fault then no, I wouldn't try to get compensation off of my employer, well they should because, I bet he took all the guards off of the machine, like I know most council workers do, love!

JOrd can I suggest you read this article published in today's northern echo. As you will see the individual was not at fault but that the so called safety equipment he was supplied with were not sufficient nor suitable for use with this machine. I do hope you're not a gambling man as in your own words "I bet he took all the guards off the machine" are also not what what happened in this case. As the employee was also wearing the "PPE equipment that they deemed to be adequate enough for him to use this machine" has now been proved it was actually completely inadequate and had been reported by others to be inadequate do you still stand by your originally statement that the employee is still at fault and not the employer? This man lost his arm through inadequate safety equipment provided by his employer I now hope he's sue them for all he can get. oh & I sincerely hope that the PPE you wear in your job is up to standard or you may one day find yourself or a colleague in the same situation. http://www.thenorthe
