CONTROVERSIAL plans for a nightspot in Durham's disused Palladium cinema look likely to go to a public inquiry.

An appeal has been lodged against Durham City Council's failure to decide the planning application within the statutory two months.

Planning officials were recommending councillors to refuse permission, because of the development's impact on residents.

Because of the appeal, the development control committee could only say that it was "minded" to reject the scheme.

Luminar Leisure, of Luton, wants to turn the Palladium into the latest in its Chicago Rock Caf chain of venues.

It would open from 10am to 1am Monday to Saturday and until 12.30pm on Sunday, offering food, music and dancing in American-style surroundings.

Residents, backed by city MP Gerry Steinberg, submitted a 202-name petition against the plan and their spokeswoman, Kirsty Thomas, told councillors they were worried about an increase in drink-fuelled nuisance.

"People have a perception that going down Claypath, particularly on Friday and Saturday nights, is very hazardous.

"It probably isn't, but it is their perception.

"Were the Palladium to be converted into this bar, restaurant and place of entertainment, it would increase the number of youngsters in Claypath and would make it far more intimidating."

Councillor Muriel Sawbridge said: "My phone has been hot ever since this application was tabled - all of it objecting.

"There is a feeling we want something done with the Palladium - it is a very interesting building - but not this.''

Police also objected, saying the nightspot would lead to more crime and nuisance and stretch their resources.

The committee recently approved plans for an Australian-themed nightspot in the Robins Cinema, North Road, despite a similar police objection, after hearing refusal could lead to an expensive appeal.

But head of planning David Thornborrow said that unlike North Road, Claypath had a many residents whose amenity would be spoiled.

Luminar Leisure is also facing several objections to its application for a drinks licence from the city's magistrates.
