COUNCILLORS have resigned following an on-going row over the build of a 'disabled' summerhouse on an allotment.

Maureen Powles wants to erect the summerhouse, which is slightly larger than rules allow, on her allotment in Hurworth, near Darlington, to provide somewhere for her to take her disabled friend.

But Hurworth Parish Council has refused permission for it to be built, saying it does not matter "whether or not the person applying is disabled".

Ms Powles said she was "disgusted" to then receive an eviction letter after she had complained about the decision.

The council defended their decision, as they say she is "not the registered tenant for this allotment".

Parish councillors David Wood and Carol Paylor have both resigned following the row.

In his resignation letter seen by The Northern Echo, Cllr Wood said: "Personally, I feel that it is a great shame that such a progressive set of councillors, that have contributed so much to the community, fail to share the same set of values that I do."

Ms Powles began constructing the summerhouse, but took it down after being made aware of the rules set by the council.

She then appealed for special permission to re-build the structure for her disabled friend, but her request was refused.

"I just want somewhere for her to feel safe and comfortable," she said.

"It would give her a change of scenery and some fresh air.

"I am disgusted to have been treated in this manner - especially when I have cooperated throughout.

"I am saddened, shocked and surprised."

Graham Wylie, chair of the parish council, said: "Having regard to the primary use of an allotment for the cultivation of vegetable and fruit, the erection of a building other than ancillary to that use is not in accordance with the legislation.

"The Council is therefore entitled to refuse consent, whether or not the person applying is disabled.

"Since Ms Powles is not the registered tenant for this allotment and has been using this plot, she has been denying another resident the chance because the previous tenant left the area and they, and Ms Powles ,failed to inform the Council."
