A MAN has appeared before magistrates charged with breaching the terms of a sexual harm prevention order for the third time.

Mark Anthony Nixon, of Cedar Grove, Shildon, County Durham, was seen in the same garden as a 12-year-old boy by a police officer on June 22.

The 29-year-old admitted this was a breach of the order at Newton Aycliffe Magistrates’ Court yesterday.

Magistrates heard Nixon was made subject to the order by Teesside Crown Court in June 2009 and had already breached it twice.

Sam Brewster, mitigating, said Nixon had been working on a car with the homeowner at the time and had not known the child was inside the property until he came out into the garden.

The case was adjourned until August 16 for reports. Nixon received conditional bail.
