A FORMER vet killed a man as they engaged in extreme drug-fuelled sado-masochistic sex before leaving his body under a duvet and having sex with another man, a court has heard.

Kirk Thompson, 46, is accused of the manslaughter of David Kochs, 43, who is originally from the Bishop Auckland area, after the pair made contact on a gay website.

The incident was alleged to have happened at Mr Thompson's flat in Dulverton Court, Jesmond, Newcastle, on March 2 last year.

A jury at Newcastle Crown Court was told today (Wednesday, March 5), Mr Thompson, who “enjoyed inflicting pain on others” was alleged to have burnt Mr Kochs, including on his private parts and inflicted at least 44 injuries on his back with a riding crop.

At one point Mr Kochs' mouth was stapled together as was one nostril with a surgical skin stapler.

Mr Kochs died of severe internal injuries caused after an electric toothbrush and metal bar were forcibly inserted into his body.

Opening the prosecution case, Robert Smith QC told the jury: "The case you are to try over the next few weeks as the jury in this trial is an unusual one. It's also a very disturbing one."

He said both men had been taking the drug crystal meth when they engaged in the violent episode.

Mr Smith said: “A large number of injuries were inflicted, some of which are likely to have been done with the deceased's agreement as part of a sado-masochistic sexual act.

“However, the prosecution questions whether all the injuries were done with his agreement or if when they were inflicted David Kochs was capable of agreeing.”

The jury was told Mr Thompson had boasted on the internet about the kind of activity the two were engaged in.

In one message he said: “I am cutting, bleeding, piercing a guy on crystal meth” and in another said that he was “having a very extreme scene”.

Medical evidence showed that Mr Kochs had been cut with a sharp instrument, with some wounds inflicted after his death, the court heard.

Mr Smith said, at some point Thompson became aware that Mr Kochs was either dead or unconscious and he covered him with a duvet on the floor of his living room.

Mr Thompson then invited round another man he had met online and had sex with him as Mr Kochs lay nearby. The second man, who told police he had been unaware of the body, left the flat at around 7am.

Shortly after 11am, Mr Thompson sent a text message to his father saying: "Can you come down immediately please, something tragic has happened, just you not Mum please ASAP."

On arriving at the flat, his father immediately dialled 999.

Mr Smith said: “The scene that confronted the police and paramedics was indeed a disturbing one.

“David Kochs was lying on the floor beside the sofa and was partially covered by a duvet.

“He was wearing only a pair of leather ankle boots and he was surrounded by instruments and objects that had been used or were intended to be used as part of sado-masochistic activity.

Mr Thompson, who had suffered no injuries, told police they had been engaged in "extreme no-limits anything goes sex" involving “consensual” bondage, fisting and cutting and taking of crystal meth.

He claimed he believed Mr Kochs had been asleep and that was why he covered him with the duvet.

Mr Smith it was the prosecution's case that Mr Thompson caused or significanly contributed to Mr Kochs' death by the deliberate and forcible insertion of instruments into his anus resulting in internal tears.

He said: “Even if Mr Kochs were in a position to consent he certainly didn't agree to the insertion of those items into his body with the degree of force required to cause those tearing injuries to his bowel.

“And even if he had consented the consent would not operate as a matter of law so as to provide the defendent with any form of defence”.

Mr Thompson denies the charges of manslaughter, an alternative charge of unlawful wounding and a third charge of assault ocassioning actual bodily harm. He has admitted possessing crystal meth.
