A new law banning people from smoking in cars with children present was passed in February this year. Here are five facts you need to know about the new legislation.
What is the new law and what's the penalty for breaking it?
From October 1, 2015, it will be illegal to smoke in a car (or other vehicles) with anyone under the age of 18 present. If you are caught breaking the law, both the driver and the smoker could be fined £50.
What if I'm 17 and a driver?
The law does not apply to 17-year-old drivers who decide to smoke in their cars while alone.
Can I vape?
E-cigarettes are not included in the new law so smokers who have chosen to vape can continue to do so.
Does it apply to convertible cars?
The law only applies to vehicles that are enclosed partly or fully by a roof. Opening windows or a sunroof does not circumvent the law and motorists can still be fined if they are smoking while sitting in the open doorway of a vehicle.
The law does not apply to a convertible car with the roof completely down.
Are motorhomes and caravans off limits?
The law only applies to motorhomes and caravans when in transit, including stopping during a journey. The law does not apply when either is being used as living quarters.
