A FIREPLACE company has won a court injunction preventing a rival firm from using web domain names that infringed its trademark.
CVO Fire took legal action against Go Modern Limited after discovering it was using names including cvofires.com and cvo-fires.com At the Patents County Court in London, Judge Michael Fysh granted an injunction in favour of the Newton Aycliffe firm, which has produced fires for a Hollywood film director as well as hotel chains including Hilton and Marriott.
Go Modern Limited was also ordered to make an initial payment of £5,000 towards CVO’s costs.
Andrew Munro, managing director of CVO Fire, said: “I am delighted that we were granted an order and injunction against Go Modern as this proves that we’re not afraid to take whatever action is required to protect our brand.
“Our business is one of continuous product development and implementation of new design ideas. We are proud of what we have achieved which has seen our reputation and sales grow by 67 per cent over the last three years.
“We are determined that our brand will not be eroded by unfair competition.”
Go Modern Ltd declined to comment.
CVO Fire, which employs 14 at Newton Aycliffe, is a member of intellectual property group Acid (Anti Copying in Design) and worked with Newcastle law firm McDaniel and Co, which advised them to issue proceedings for infringement of their Registered Trade Mark CVO.
